ONLINE DISPUTE
RESOLUTION (ODR)

Online Dispute Resolution in South Tyrol

Alternative Dispute Resolution (ADR) refers to methods of resolving disputes other than state judicial proceedings.
They are often described as structured methods of dispute resolution, where an outcome is achieved with the help of a third party, although it is not legally binding.

ADR aims to address the inflexibility of the state judicial process, achieve a fairer outcome for the involved parties, and restore legal peace.

Online Dispute Resolution
With the EU regulation on online dispute resolution for consumer rights, ADR has been integrated with an online component. The purpose of the regulation, according to Art. 1, is: "...to contribute to the smooth functioning of the internal market, in particular of its digital dimension, by achieving a high level of consumer protection through the establishment of a European online dispute resolution platform (hereinafter 'ODR platform') which allows for the out-of-court resolution of disputes between consumers and traders which stems from online sales or service contracts."
